Terms of Service

Preamble

These Terms of Service ("Agreement") together with our Privacy Policy govern your use of the FlashSMS platform operated by Codeslaw Global Technologies ("we", "us", "our"). By creating an account you accept these terms in full.

1. Definitions

• Codeslaw Global Technologies: The company operating FlashSMS, registered in Ghana.
• You / Your: The individual or entity registering for and using the platform.
• Service: The FlashSMS web platform accessible at https://app.flashsms.africa.
• Credits: Pre-purchased SMS units used to send messages through the platform.
• Your Data: All content and information you submit to the platform, including contact lists and message content.

2. Changes to Terms

We reserve the right to update these Terms at any time by posting the revised version on our website. Continued use of the platform after changes constitutes acceptance. Where material changes are made, we will provide reasonable notice.

3. Eligibility

You must be at least 18 years old to use FlashSMS. Accounts used in violation of these Terms may be terminated without notice.

4. Account Registration

Access to the platform requires registration with a valid phone number and password. You are solely responsible for all activity on your account and must keep your credentials secure.

5. Credits and Payment

SMS credits are purchased in advance and deducted per message sent. Prices are listed on the platform and may change from time to time. You are responsible for any applicable taxes. Credit purchases require valid payment authorisation.

6. Refunds

All credit purchases are final and non-refundable unless the platform fails to deliver due to an error on our part. Refund claims must be submitted within 7 days with supporting evidence. Repeated claims, suspected fraud, or breach of these Terms void refund eligibility.

7. Termination

Accounts may be terminated immediately for breach of these Terms, the Privacy Policy, or any applicable law. Upon termination, unused credits are forfeited.

8. Force Majeure

Neither party is liable for failure to perform due to causes beyond reasonable control including natural disaster, government action, civil unrest, or third-party network failures.

9. Our Responsibilities

Codeslaw Global Technologies will: maintain the FlashSMS platform with reasonable uptime (excluding planned maintenance); provide customer and technical support; comply with applicable Ghanaian law; and implement reasonable data security measures.

11. Campaign Content

You are solely responsible for the content of all messages you send through the platform. You agree to indemnify Codeslaw Global Technologies against any claims arising from your campaign content or distribution practices.

12. Acknowledgements

You acknowledge that: SMS delivery depends on third-party mobile network operators and is not guaranteed; occasional downtime may occur; and FlashSMS is provided on a best-effort basis.

13. Intellectual Property

All platform software, trademarks, and content belong to Codeslaw Global Technologies or its licensors. You retain ownership of your data and campaign content. You grant us a limited licence to host and transmit your content solely to provide the service.

14. Confidentiality

Both parties agree to keep non-public information confidential and not disclose it except to employees or contractors who need it to perform their duties, or as required by law.

15. Prohibited Use

You may not use FlashSMS to send: messages that violate bulk SMS or marketing communications laws; sexually explicit content; hate speech or discriminatory content; fraudulent or phishing messages. Violations result in immediate account deactivation and forfeiture of credits.
